Ombudsmen: They may be kept in custody for a maximum of 12 hours

Public Defender Nino Lomjaria has released a statement on the court hearing at which 18 November detainees' case is being discussed.

"The representatives of the Public Defender Office has kept the court trial under careful observation all day long on November 19. It is paramount that all detainees and their lawyers be provided with sufficient time and opportunities to defend their positions.

According to information held by us, some detainees were apprehended on 18 November during working time and, in accordance with the legislation of Georgia, they may be kept in custody for a maximum of 12 hours and freed after this period of time expires.

I also want to stress that the case of the detainees over administrative offences is being discussed by one judge only, with this naturally slowing the process of rendering justice. Consequently, it is mandatory that other judges be involved in the process so that the detainees' rights are not breached.

We do appeal to the Tbilisi City Court to hold the court trial in a timely manner and in compliance with the legislation," reads the Ombudsmen's statement.
