Public Defender demands unconstitutional recognition of the procedure for selecting Supreme Court Justice candidates. Nino Lomjaria has already appealed to the Constitutional Court of Georgia with the request.
The Ombudsman thinks that decisions are made in secret and without justification. She also pointed out that there is the lack of opportunity to appeal these decisions.
"The selection procedure does not exclude the risk of arbitrariness, as the secret ballot under the impugned norm does not oblige the High Council of Justice to substantiate its decision. In particular, why a certain candidate was favored and other refused. This rule does not ensure a fair process and candidates who meet the requirements of the law unjustifiably limit their ability to be selected in accordance with their professional or other personal preferences", the Public Defender said.
